1. Welcome

Welcome to Destiny Charm Divination.

These Terms & Conditions ("Terms") govern your use of the Destiny Charm Divination website and your purchase or use of our products, services, readings, memberships, subscriptions, digital materials, and other offerings.

By making a purchase, booking a service, joining a subscription, or otherwise using our paid offerings, you agree to the Terms applicable to that transaction.

Please also review our Privacy Policy, which explains how personal information is collected, used, and protected.

2. About Destiny Charm Divination

Destiny Charm Divination is a division of I Woke Up Awesome, LLC.

We offer products and experiences designed around charm divination, intuitive exploration, reflection, creativity, and personal meaning.

Offerings may include:

• Charm and intuitive readings;
• Mediumship experiences;
• Physical charms and charm collections;
• Curated or mystery charm scoops;
• Affirmation and divination tools;
• Digital products, e-books, guides, and downloadable materials;
• Charm Divination Dispatch Mail Club memberships;
• One-time Mail Club experiences, gifts, or archived editions; and
• Other related products, services, and educational content.

Availability, pricing, descriptions, and features may change over time.

3. Intuitive, Charm & Mediumship Services

Charm readings, intuitive readings, mediumship experiences, and similar offerings are provided for personal insight, reflection, spiritual exploration, and entertainment purposes.

By purchasing or participating in one of these services, you understand and agree that:

• No particular message, prediction, outcome, or connection is guaranteed;
• A requested mediumship connection or communication is not guaranteed;
• Individual experiences and interpretations vary;
• Readings reflect intuitive and symbolic interpretation;
• You remain responsible for your own decisions and actions; and
• You should use your own judgment when considering information received during a reading.

Not Professional Advice

Destiny Charm Divination does not provide medical, mental-health, legal, financial, or other licensed professional advice.

Our readings, products, educational materials, and other content should not be used as a substitute for qualified professional advice, diagnosis, treatment, counseling, or services when those are appropriate.

If you need professional assistance, please consult an appropriately qualified professional.

4. Reading Reservations & Payments

Certain readings may require a reservation payment to secure a place in an upcoming reading cycle or appointment.

Unless otherwise stated at the time of purchase:

• The reservation payment is applied toward the stated total price of the reading;
• The remaining balance must be paid according to the instructions and timeframe provided;
• A reserved spot may be released if the remaining balance is not paid within the communicated timeframe; and
• Reservation payments are generally non-refundable once the reservation has been made, except where otherwise required by law or where Destiny Charm Divination is unable to provide the purchased service.

The specific price, reservation amount, and applicable terms displayed when you make your purchase are part of your transaction.

5. Digital Products

Digital products may include e-books, guides, downloads, printable materials, educational resources, and similar content.

Unless otherwise stated:

• Digital products are licensed for your personal, non-commercial use;
• You may not reproduce, redistribute, resell, upload, publish, or commercially exploit the material without written permission;
• Access may be provided through download, email, or another electronic delivery method; and
• You are responsible for maintaining access to your email and downloaded files.

Because digital products may become immediately accessible after purchase, digital-product purchases are generally final once delivered or accessed, except where the product is defective, was not delivered as promised, or a refund is otherwise required by applicable law.

6. Physical Products

We make reasonable efforts to describe physical products accurately.

Because many Destiny Charm Divination products are curated, intuitive, handmade, assembled, or contain assorted charms or other small items, reasonable variations may occur.

Product photographs may be representative. Colors, finishes, charm assortment, packaging, and other details may vary where the product description indicates that an item is assorted, intuitive, mystery-based, handmade, or otherwise subject to variation.

If you receive the wrong item, a materially damaged item, or an order with a significant fulfillment problem, please contact us so we can review the issue and determine an appropriate resolution.

Nothing in these Terms limits any rights or remedies that cannot lawfully be waived.

7. Shipping & Delivery

Shipping estimates are provided in good faith but are not guaranteed delivery dates unless expressly stated otherwise.

Delivery may be affected by postal carriers, weather, holidays, customs processing, service disruptions, incorrect addresses, and other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address.

If you discover an address error, contact us as soon as possible. We cannot guarantee that an address can be changed after an order has entered fulfillment or has been shipped.

Lost, Delayed, or Damaged Shipments

If a shipment appears lost, arrives damaged, or has another delivery problem, please contact us.

We may ask you to provide relevant information or photographs and may work with you and the applicable carrier to investigate the issue.

Any remedy will depend on the circumstances, applicable carrier policies, and applicable law.

We do not use a blanket rule stating that all responsibility automatically transfers to the customer the moment a package is given to a carrier. Rights and responsibilities concerning risk of loss can depend on the transaction and applicable law. Maryland law, for example, distinguishes between different delivery arrangements and circumstances. Maryland General Assembly

8. International Orders

Certain products may be available for shipment outside the United States.

Availability depends on the product and the destinations supported at checkout.

For the Charm Divination Dispatch Mail Club:

• Tier 1 may be available to supported international destinations;
• Tier 2 is currently available only for eligible U.S. shipping addresses; and
• Tier 3 is currently available only for eligible U.S. shipping addresses.

International shipments may be subject to customs processing, import restrictions, taxes, duties, fees, or delays imposed by the destination country.

Unless otherwise stated at checkout or required by law, customers are responsible for import duties, customs charges, or similar destination-country charges that may apply.

We reserve the right to restrict shipment of particular products to destinations where shipping, customs, carrier, or legal requirements make fulfillment impractical.

9. Charm Divination Dispatch Mail Club

The Charm Divination Dispatch Mail Club includes both recurring membership options and, when offered, separate one-time experiences.

Recurring Membership

When you purchase a recurring Mail Club membership, you are enrolling in an automatically renewing monthly subscription.

Your checkout page will display the price applicable to the membership you select.

Unless canceled, your selected payment method will be charged automatically each billing cycle at the applicable subscription price, plus any required taxes.

There is no fixed commitment period unless specifically stated at checkout.

Current Membership Tiers

Current recurring membership options may include:

Tier 1 — $7 per month
A monthly mailed experience featuring the items and benefits described on the Mail Club page at the time of enrollment.

Tier 2 — $22 per month
Includes the Tier 1 experience plus additional physical charm and intuition-development benefits as described on the Mail Club page.

Tier 3 — $52 per month
Includes the Tier 2 experience plus a personalized monthly charm reading delivered as a recording, as described on the Mail Club page.

Applicable taxes may be added where required.

Special, promotional, affiliate, or grandfathered pricing may apply to eligible members. If such pricing applies, the amount presented and agreed to at enrollment or otherwise confirmed for your subscription governs your billing unless lawfully changed with appropriate notice.

Tier 3 Capacity

Tier 3 is limited to 20 active members because each membership includes a personalized monthly charm reading.

Availability is therefore not guaranteed.

When Tier 3 reaches capacity, enrollment may be closed or a waitlist or alternative offering may be provided.

10. Automatic Renewal & Authorization to Charge

By completing checkout for a recurring Mail Club membership, you authorize the applicable payment processor to charge your selected payment method for your initial purchase and subsequent recurring monthly subscription charges until the subscription is canceled.

The recurring nature of the subscription, price, billing interval, and other material purchase information are presented as part of the enrollment and checkout process.

You are responsible for maintaining a valid payment method.

Destiny Charm Divination does not enroll customers in a recurring Mail Club subscription merely because they make a one-time purchase.

Our one-month trial experiences, one-time products, Gift Dispatch offerings, and other items identified as one-time purchases do not automatically convert into recurring subscriptions unless the applicable checkout expressly states otherwise and you affirmatively enroll in such an arrangement.

Clear disclosure and informed consent around recurring charges are particularly important under U.S. consumer-protection law; the FTC continues to enforce against practices involving allegedly undisclosed subscriptions, charges without adequate consent, and obstructive cancellation. 11. Billing Date

Your first subscription payment is generally charged when you enroll unless your checkout or subscription confirmation expressly provides otherwise.

Subsequent charges generally recur monthly based on your subscription billing date.

Because months contain different numbers of days and payment processing can occasionally be affected by technical or banking circumstances, the exact processing time may vary.

Your Stripe Customer Portal and Stripe communications may provide information about your subscription and billing.

12. Failed or Declined Subscription Payments

If a recurring payment is declined or otherwise fails, Stripe or Destiny Charm Divination may notify you and may attempt to collect the payment again according to the billing system's configured payment-recovery process.

You may be asked to update your payment information through the secure Stripe Customer Portal.

A failed or unpaid subscription payment may result in delayed or withheld fulfillment and may ultimately result in cancellation or suspension of the subscription.

We do not guarantee that an unpaid monthly Mail Club edition will be reserved indefinitely.

This section replaces any previous Mail Club instructions requiring customers to manually retry payments through a Destiny Charm Divination website-store account.

13. Managing Your Mail Club Membership

Eligible Stripe-based Mail Club memberships can be managed through the secure Stripe Customer Portal linked from the Destiny Charm Divination website.

Depending on your membership and the options currently available, the portal may allow you to:

• Update eligible payment information;
• Update billing or shipping information;
• View subscription information;
• Switch between eligible membership tiers; and
• Cancel your recurring membership.

Certain membership changes may be restricted based on availability.

In particular, customers cannot freely switch into Tier 3 through the Customer Portal because Tier 3 is subject to the 20-member capacity limit.

14. Cancellation

You may cancel a Stripe-based recurring Mail Club membership through the secure Customer Portal.

Under the current membership configuration, cancellation generally takes effect at the end of your current paid billing period.

This means:

• You may continue receiving the benefits associated with the paid period through its applicable end;
• Your subscription will not renew for another billing cycle after the cancellation becomes effective; and
• You will not be charged for a subsequent billing cycle unless you reactivate or purchase another subscription.

To avoid an upcoming renewal, submit your cancellation before that renewal is processed.

If you experience a technical problem that prevents you from accessing the Customer Portal or completing cancellation, contact Destiny Charm Divination promptly for assistance.

We will not intentionally require unnecessary steps or use unreasonable obstacles to prevent cancellation.

15. Membership Changes

Eligible members may be able to switch between Tier 1 and Tier 2 through the Customer Portal.

Where the portal indicates that a membership change will take effect at the next billing cycle, the existing membership remains in effect through the current paid period and the new membership and pricing begin with the next applicable billing period.

Tier 3 enrollment and changes involving Tier 3 are handled separately because of its limited capacity.

Available membership-management options may change as our offerings evolve.

16. Subscription Refunds

Recurring subscription charges are generally non-refundable once processed because fulfillment planning, preparation, personalized work, and/or benefits may begin shortly after renewal.

However, this policy does not eliminate any refund, cancellation, charge-dispute, or other consumer rights that apply under law.

If you believe you were charged in error, canceled before a charge should have occurred, were charged an incorrect amount, or experienced another billing problem, please contact us promptly so we can investigate.

17. One-Time Mail Club Experiences & Gifts

Not every Mail Club-related product is a recurring subscription.

One-time trials, Gift Dispatch purchases, archived editions, and other offerings identified as one-time purchases do not automatically renew unless expressly stated otherwise at checkout.

Gift offerings may have separate duration, fulfillment, recipient, and shipping terms displayed at purchase.

If a recurring gift membership is offered, the checkout will identify it as recurring and explain the applicable recurring price and billing terms.

18. Pricing, Promotions & Discounts

Prices are displayed in U.S. dollars unless otherwise stated.

Applicable sales or other transaction taxes may be added at checkout where required.

We may offer coupons, promotional pricing, affiliate pricing, grandfathered pricing, member benefits, or limited-time offers.

Promotions:

• May be subject to eligibility requirements;
• May apply only to specified products or membership tiers;
• May have expiration dates or other stated restrictions;
• May not be combined unless expressly permitted; and
• Do not create a right to future discounted pricing unless the applicable offer expressly provides for ongoing pricing.

If an ongoing subscription discount applies, its duration and effect will be governed by the terms of that particular promotion.

19. Refunds & Returns Generally

Because Destiny Charm Divination offers several different types of products and services, refund eligibility depends on what was purchased and the circumstances.

Unless otherwise stated and subject to applicable law:

• Completed readings are generally non-refundable;
• Reading reservation payments are generally non-refundable after the reservation has been secured;
• Delivered or accessed digital products are generally non-refundable;
• Processed subscription charges are generally non-refundable; and
• Physical-product problems will be reviewed based on the circumstances.

If an item is defective, materially damaged, incorrect, not delivered as promised, or affected by another significant fulfillment issue, contact us.

Nothing in these Terms is intended to waive rights or remedies that cannot lawfully be waived.

20. Reiki, Energetic & Spiritual Elements

Some Destiny Charm Divination products or services may be prepared or presented with Reiki, intention-setting, intuitive selection, spiritual symbolism, or similar practices.

These elements are offered as part of the personal, reflective, or spiritual experience of the product or service.

We do not guarantee a particular energetic, emotional, spiritual, health, financial, relationship, or other outcome.

Your beliefs, interpretation, experience, and response are personal to you.

21. Small Items & Product Safety

Many of our products contain small charms or other small components.

Unless a product is expressly described otherwise, Destiny Charm Divination charms and related products are not toys and are not intended for young children.

Small items may present a choking hazard.

Keep charms, beads, findings, and other small components away from young children and pets.

22. Intellectual Property

Unless otherwise stated, the website and its original content—including text, graphics, branding, product concepts, photographs, downloadable materials, guides, reading materials, educational resources, and other original content—are owned by or licensed to Destiny Charm Divination / I Woke Up Awesome, LLC and are protected by applicable intellectual-property laws.

Purchasing a product does not transfer ownership of our intellectual property.

You may not, without appropriate permission:

• Reproduce or redistribute protected content;
• Resell digital materials;
• Publish substantial portions of paid materials;
• Use our protected content commercially;
• Impersonate or misrepresent an affiliation with Destiny Charm Divination; or
• Use our trademarks, branding, or copyrighted materials in a manner prohibited by law.

Nothing in this section is intended to restrict rights such as fair use or other rights provided by law.

23. Customer Content & Communications

If you send us a review, testimonial, photograph, story, message, or other content, we will not treat that submission as automatically granting unlimited permission to use it publicly unless permission is reasonably clear from the circumstances or separately obtained.

If we wish to feature personally identifiable customer content in marketing beyond what the customer has authorized, we may request permission.

Communications sent for customer service, order fulfillment, readings, or other private purposes are not automatically public testimonials.

24. Fraud, Abuse & Unauthorized Activity

You may not use our website, products, payment systems, accounts, or services for unlawful, fraudulent, abusive, deceptive, or unauthorized purposes.

We may refuse or cancel transactions where reasonably necessary to address suspected fraud, payment abuse, security threats, unlawful activity, or material violations of these Terms, subject to applicable law and any required refunds.

25. Scam & Impersonation Awareness

Destiny Charm Divination does not use unsolicited pressure tactics to convince individuals to purchase readings.

Be cautious of accounts or individuals impersonating Destiny Charm Divination, particularly those demanding urgent payment or claiming you must purchase a reading because of a frightening prediction, curse, emergency, or similar threat.

If you are uncertain whether a communication is authentic, contact us through the contact information published on our official website.

26. Third-Party Services

Our website and business rely on third-party services, which may include website/ecommerce providers, Stripe, Mailchimp, postal carriers, and other technology or service providers.

Those providers operate their own services subject to their respective terms and privacy practices.

We are not responsible for independent third-party websites or services outside our reasonable control, but nothing in this section limits responsibility that applicable law places on Destiny Charm Divination for our own transactions or conduct.

27. Availability & Changes to Offerings

We may add, modify, discontinue, or limit products, services, membership tiers, features, or future offerings.

Changes to future offerings do not automatically alter the terms of an already completed purchase.

For recurring memberships, material changes affecting an existing subscription will be communicated or implemented in accordance with applicable law and the terms applicable to that subscription.

We will not rely merely on a general website update to impose a material retroactive change where additional notice or consent is legally required.

28. Limitation of Liability

To the fullest extent permitted by applicable law, Destiny Charm Divination and I Woke Up Awesome, LLC will not be liable for indirect, incidental, special, consequential, or similar damages arising from the use of our website, content, products, or services where such limitation is legally permitted.

We are not responsible for decisions made solely in reliance on intuitive, spiritual, or entertainment content.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, nor does it eliminate non-waivable consumer rights.

29. Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles, except to the extent that applicable consumer law requires otherwise.

Consumers may also have rights under the laws applicable to them that cannot be waived by contract.

30. Changes to These Terms

We may update these Terms to reflect changes in our business, offerings, technology, or legal obligations.

The Effective Date at the top of this page will identify the current version.

Changes generally apply prospectively from their effective date.

Material changes affecting an existing paid purchase or recurring subscription will be handled in accordance with applicable law and any additional notice or consent requirements that apply.

Continued general use of the website after an update does not waive rights that cannot lawfully be waived.

31. Severability

If a provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the extent necessary where legally permitted, and the remaining provisions will continue in effect.

32. Entire Agreement

These Terms, together with the terms presented at checkout and any policies or disclosures expressly incorporated into a particular transaction, form the agreement governing that purchase or service.

If specific terms presented for a particular product or transaction conflict with these general Terms, the more specific transaction terms generally control for that transaction, subject to applicable law.
